Settlement transactions sometimes produce dust outputs

Transactions with dust outputs will not be relayed by peers, and I have noticed some settlement transactions produced with dust output.

Peers also ban a hosts sending invalid transactions. Does a transaction with dust output qualify as an invalid transaction which can lead to banning?
